THE PAD CO-LIVING, AT BANILAD HIGH STREET (THE PAD), its affiliates and subsidiaries, directors, officers, and employees recognize and respect each individual’s privacy and is committed to comply with the Data Privacy Act of 2102.

In this Privacy Policy, we disclose how THE PAD collects, processes, protects, and manage personal and sensitive data we collect in connection with dealing or transacting with us.

Data We Collect

We collect the following data:

  1. Information relating to identity, such as full name, age, gender, date of birth, nationality, race, ethnicity, civil status, address, e-mail address, contact details, government issued identification documents, and other details necessary for reservation/lease agreements;
  2. Information relating to credit/debit cards, bank details used for payments;
  3. Information provided for and disclosed in any inquiry, booking or reservation, confirmation voucher form, as well as other forms of THE PAD; and
  4. Other information provided in the course of dealings or transactions with THE PAD.

 

Consent to Data Collection

By indicating and submitting personal data through any of the dealings or transactions with THE PAD, data subjects must expressly agree to, consent, and authorize THE PAD to collect, hold, store, process, use, transfer and/or disclose personal data in accordance with this Policy. Data subjects must acknowledge that the collection, use, storage, and processing of personal data is necessary for the intended purpose/s as stated in this Policy.

Data subjects acknowledge and confirm awareness and understanding to their rights under the Data Privacy Act and its pertinent regulations and issuances, including the right to be informed, to access, to object, to erasure or blocking, to damages, to file a complaint, to rectify and to data portability, and understand that there are procedures, conditions, and exceptions to be complied with in order to exercise or invoke such rights. When the data subjects disclose to us personal data of another person (e.g. their spouse, children, parents, and/or dependents), the data subjects attest that consent has been secured from that person to disclose and process the personal data in accordance with this Policy.

Manner of Collection

  1. We collect data in the following manner: Cookie-based when using our websites;
  2. Consent-based through online forms submission; and
  3. Consent-based through submission of our designated forms to our employees or duly authorized representatives.

 

Use and Purpose

We use and process collected personal data of data subjects for the following
lawful and legitimate purposes:

  1. Prepare necessary reservation/lease arrangements, and other relevant
    documents;
  2. Communicate advisories, and respond to queries or requests;
  3. Process information for statistical, analytical, advertising, and marketing opinion research purposes;
  4. Assist data subjects/customers in their concerns;
  5. Use for internal purposes such as auditing, data analysis and research to improve our products, services and customer communications; and
  6. Any other purpose analogous or related to any of the above.

 

Sharing and Disclosure

THE PAD will keep the personal data confidential. Nonetheless, we reserve
the right to disclose and transfer, as may be necessary, to third party
companies, entities, or service providers such as the following:

  1. Government agencies such as, BIR;
  2. External professional advisors such as auditors and legal counsels; and
  3. Such other necessary service providers.

 

THE PAD reserves the right to disclose personal data if we are compelled to
do so by a court of law or requested by a government entity or if we determine it necessary or desirable to comply with the law or to protect or defend our
rights or property.

Protection, Retention, and Disposal

Further to above, THE PAD will also take all necessary technical, organizational, and physical measures to protect confidentiality and security of personal data. We will retain documents containing personal data to the
extent required in our contracts or in law, and as retention may be relevant to
any ongoing or prospective legal proceedings.

Thereafter, we will dispose said documents containing personal data in a secure manner which will prevent further processing, unauthorized access, or public disclosure.

 

Updating and Corrections
THE PAD will respond to reasonable requests to review, update, modify, correct, or delete data subjects’ personal data in accordance with the Data Privacy Act of 2012, its IRR, and other pertinent laws and issuances.
